Short answer: Renting in Spain as an international student starts by identifying the contract you are actually being offered. A permanent-home lease and a seasonal student lease do not automatically follow the same deposit rules. After moving in, empadronamiento is a separate municipal procedure, so the proof accepted in Madrid may not match the checklist used in Barcelona.

Before sending documents: identify the Spanish contract type
Spain’s national Urban Leases Act (Ley de Arrendamientos Urbanos, or LAU) separates a lease used to meet the tenant’s permanent housing need from a lease for another use, which includes seasonal arrangements. An academic-year stay is often offered as an arrendamiento de temporada, but the heading alone does not settle whether the contract is appropriate. The text should state the temporary reason, dates, property, rent and conditions clearly.
Ask the provider to write down whether the offer is for a whole dwelling, one room, a student residence place or a seasonal dwelling. Room contracts and residence agreements can involve different rules and services from a standard whole-home lease. Do not assume that “nine months” automatically gives you every protection or obligation of a permanent-home contract.
How the contract changes the statutory deposit
Article 36 of the national LAU sets the cash fianza at one month of rent for a dwelling lease and two months for a lease for use other than housing. The Act classifies seasonal leases under use other than housing. Autonomous communities can regulate where the landlord must lodge that statutory deposit, and regional rules can add important detail.
A statutory fianza is not the same thing as every extra guarantee a provider may propose. Before paying, request an itemised written total showing the first rent, statutory deposit, any additional guarantee, service charge and platform fee. The LAU also states that the refundable cash balance starts accruing legal interest if it has not been returned one month after the keys are handed back.
A Spain-specific document workflow
- Ask for the contract category and temporary purpose. If it is seasonal, confirm that the academic reason and exact term appear in the agreement.
- Match your evidence to that purpose. A provider may ask for admission or enrolment proof to document a student stay; ask why each financial or identity document is needed.
- Separate the payment lines. Identify renta, fianza, any additional guarantee and fees instead of accepting one unexplained transfer amount.
- Confirm the regional deposit route. The landlord, not the student, normally handles lodging the statutory deposit with the relevant regional body where required. Ask for evidence when the regional procedure provides it.
- Check municipal registration before booking. Ask whether the exact room or residence address can support empadronamiento and what document the provider will issue.
Empadronamiento is municipal, not a landlord application
The padrón municipal records where you actually live. Its evidence rules are administered locally. Madrid’s published checklist accepts an in-force rental contract for a dwelling or room and sets identity-document requirements, including a valid passport in relevant cases. Barcelona adds different routes: when the contract is in somebody else’s name, it asks for authorisation and the contract holder’s identity document; a collective address such as a student residence uses an authorisation signed and stamped by the responsible entity.
That difference is practical: a valid booking confirmation may still be insufficient for a specific municipal appointment. Check the municipality after you know the exact address, not just the country. Empadronamiento also does not replace EU registration, a visa or a residence permit.
